JOE O’REILLY’S ATTEMPT TO HAVE MURDER CONVICTION DECLARED MISCARRIAGE OF JUSTICE FAILS
The Court of Appeal has thrown out Joe O’Reilly’s attempt to have his conviction for the murder of his wife Rachel declared a miscarriage of justice.
Rachel’s mother, Rose Callelly, reacted with delight to the ruling but says she still hopes that someday her daughter’s killer will admit his guilt.
Joe O’Reilly was jailed for life 8 years ago for the murder of his wife Rachel who was bludgeoned to death at their home in the Naul in North Dublin in 2004.
After losing an appeal the 42 year old again tried to have his conviction quashed by claiming new or newly discovered facts showed his trial had led to a miscarriage of justice.
The main point argued was that the book of evidence had been left in the jury room on day 3 of the trial.
But the Court of Appeal has found Joe O’Reilly was fully informed of that fact at the time and it’s granted a request by the DPP to throw out this latest bid for freedom as an abuse of process.
Rose Callely, the mother of murdered Rachel said she’s delighted at the outcome.
As for Joe O’Reilly he’s run out of appeal options, dressed in a dark suit and striped toe, he showed little reaction to the court’s ruling.
