FINANCE COMPANY LOOKS FOR ENNISCORTHY BROTHERS TO REPAY 4.4 MILLION EURO LOANS
A finance company is seeking summary judgment against two County Wexford brothers over alleged unpaid loans of almost 4.5 million euro.
Emberton Finance claims it’s owed the money by businessmen John and Michael Kinsella, both of Tomadilly, Marshalstown in Enniscorthy.
The case was admitted to the Commercial Court list yesterday on the application of Emberton.
The case arose out of money advanced to the Enniscorthy brothers by Friends First Finance in June 2008 for land in New Ross and Ferns – with the loan then assigned to Emberton in 2014.
The finance company says the Kinsella’s have failed or refused to repay the loans – something they deny – and receivers have been appointed to the land.
The brothers, who represented themselves, opposed to the matter being admitted to the Commercial Court list – and also want to defend Emberton’s claim against them.
Mr Justice Brian McGovern said he was concerned about some of the documentation presented to the court on the brothers’ behalf and adjourned the matter to later this month.
