COURT CASE OVER FATAL ACCIDENT IN ADAMSTOWN IN 2009
The Court of Criminal Appeal has found it would be unjust to jail a man who had avoided a custodial sentence when he appeared before Wexford Circuit Criminal Court
The case involved a fatal road accident in which a twenty one year old Adamstown woman lost her life
The case came before the Court of Criminal Appeal after the DPP appealed against the undue leniency of the original sentence
Thirty six year old Robert Eustace with an address at Bachelors Hall Hayestown was before the Appeal Court after he had avoided a custodial sentence and was fined 1,500 euro
The court case in 2011 related to a dangerous driving charge resulting in the death of twenty one year old Aoife Kelly from Adamstown on the 18th of September 2009
A lorry driven by Robert Eustace veered to its incorrect side of the road and crushed the car driven by Ms. Kelly
He had a history of blackouts and was under medical advice not to drive a heavy goods vehicle
The Wexford Circuit Court disqualified Robert Eustace from driving for eight years
At the Court of Criminal Appeal Mister Justice Adrian Hardiman imposed a sentence of four years imprisonment susepended for the eight year period of driving disqualification with a warning that driving during this period would automatically mean being sent to jail
There was no evidence that Robert Eustace suffered a blackout or similiar seizure at the time of this accident
